Terms of Service

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the Dusk Analyst website, web application, and related services (together, the "Service"), operated by Dusk Analyst ("we", "us", or "our"). By creating an account, logging in, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

The Service is intended for users who are at least 18 years of age. By using the Service, you represent and warrant that you are at least 18 years old and that you have the legal capacity to enter into these Terms. The Service is not directed at, and we do not knowingly collect personal information from, anyone under 18. If you believe a user under 18 has provided us with personal information, contact us at support@duskanalyst.com.

3. Accounts and Authentication

You must create an account (via our authentication provider) to use the Service. You agree to:

  • provide accurate, current, and complete information when you register, and keep it up to date;
  • maintain the security of your login credentials and not share them with anyone;
  • not create accounts for anyone else without their authorisation; and
  • notify us if you believe your account has been compromised.

You are responsible for all activity that occurs under your account. We may suspend or terminate accounts that violate these Terms or any applicable law.

4. What the Service Does

Dusk Analyst is a trading journal that helps you record, review, and understand your own historical trading activity. The Service lets you:

  • create multiple journal accounts (for example, by broker, strategy, or prop-firm challenge) with starting balances;
  • record trades manually or import them from a CSV or report exported by your platform (MetaTrader 4/5, cTrader, TradingView and Tradovate exports are recognised automatically; any other CSV can be mapped to your own columns);
  • auto-sync closed trades from MetaTrader 4, MetaTrader 5, or cTrader using optional connector files (Expert Advisors / cBots) that push closed trades to the Service using a per-account API key;
  • attach screenshots and notes to trades, and organise trades with tags;
  • view performance statistics, P&L charts, and a trade calendar;
  • use AI-powered features (the "Insights" chat and automated Weekly Reports, together referred to as "Quant AI") that analyse your own trade data; and
  • generate shareable Weekly Reports via unique links.

Some features, including Quant AI and Weekly Reports, are Pro features available under a paid subscription as described in Section 6.

5. Connectors, API Keys, and Third-Party Platforms

The Service integrates with third-party trading platforms, including MetaTrader 4, MetaTrader 5, cTrader, TradingView, and Tradeovate. These platforms are owned and operated by their respective providers. We are not affiliated with, endorsed by, or sponsored by any of these providers, and we make no representations about them or their software.

Connector files (Expert Advisors for MetaTrader, cBots for cTrader) are provided as-is to let your terminal push closed-trade records to the Service. Each journal account has a unique API key used to authenticate those syncs. You are responsible for:

  • keeping your API keys confidential — anyone with a key can push trades to that account;
  • ensuring you comply with your broker's and platform provider's rules when running connector files; and
  • verifying that synced records are complete and accurate before relying on them.

You can regenerate an API key at any time from the dashboard, which invalidates the previous key and requires you to update it in your trading platform.

6. Pro Subscription and Billing

Pro features require an active paid subscription ("Pro"). Subscriptions are billed in advance on a recurring basis through Stripe, at the fee shown to you at checkout. By subscribing you agree to pay those fees, and you authorise Stripe to charge the payment method on file.

  • Free trial. We may offer a free trial of Pro (currently 30 days if you start it within one hour of creating your account, or 15 days if you start it within 24 hours; after 24 hours no trial is offered; one per account, for accounts that have never had a Pro subscription or trial). Starting a trial requires a payment method, and nothing is charged when it starts. Unless you cancel before the trial ends, your payment method is charged the Pro fee shown at checkout on the day the trial ends, and then on each renewal. We email you a reminder before the first charge. If you cancel during the trial, the trial ends immediately, you are not charged, and you move to the free plan with your data intact.
  • Renewal. Pro subscriptions auto-renew until cancelled.
  • Cancellation. You can cancel at any time from the Manage Subscription screen (which opens the Stripe billing portal). Cancellation takes effect at the end of the then-current billing period; you keep Pro access until that period ends.
  • Refunds. Fees are non-refundable except where required by applicable law. We may offer a refund in our discretion in individual hardship cases.
  • Price changes. We may change subscription fees, with notice where required by law. Price changes do not affect an already-paid period. Continued use after a price change takes effect constitutes acceptance of the new fee.
  • Failed payments. If a payment fails, Pro access may be downgraded. See our payment processor's terms for details on payment handling.

Affiliate codes may provide a discount on the first billing period, as described in the Affiliate Program. Discounts apply only as shown at checkout.

7. Affiliate Program

The Service may offer an affiliate program. Affiliate applications are reviewed and approved manually. Approved affiliates receive a unique code that, when used by a new customer at checkout, may apply a discount (for example, 10% off the first month) and is tracked for reporting purposes. We may change, suspend, or terminate the affiliate program at any time. Affiliate payout terms, if any are ever offered, will be published separately before any payments are made. The affiliate program is governed by these Terms.

8. Sharing and Public Reports

You can generate shareable Weekly Report links. Anyone who has the link can view the report page without logging in. Shared report pages show percentage-based statistics and AI insight cards; they do not display dollar amounts. You are responsible for who you share links with, and you can stop sharing by deleting or regenerating the report. Treat share links as public once shared.

9. AI Features (Quant AI)

Quant AI analyses only the trade data you have recorded in the Service, within the account and date range you select. It is designed to describe patterns, performance, and behaviour that are present in your own historical data. It is not a recommendation engine, and it does not provide predictions, signals, or advice of any kind (see Section 14).

AI-generated output may be inaccurate, incomplete, or unsuitable for your circumstances. You are solely responsible for evaluating any AI output before acting on it. Do not rely on AI output for decisions with significant consequences.

10. Acceptable Use

You agree not to misuse the Service, including by:

  • attempting to access another user's data or account;
  • probing, scanning, or testing the security of the Service or its infrastructure;
  • using the Service to transmit unlawful, harmful, or infringing content;
  • reverse-engineering, decompiling, or scraping the Service beyond normal use;
  • using automated tools to abuse the Service, its API, or its connectors;
  • impersonating any person or entity, or misrepresenting your affiliation; or
  • using the Service in violation of any applicable law or regulation, including laws on trading, financial services, and market conduct.

11. Your Content and Our IP

You own the trade records, notes, tags, screenshots, and other content you submit to the Service ("your content"). You grant us a limited, non-exclusive, worldwide licence to store, process, and display your content solely to operate and provide the Service to you (including transmitting it to our AI provider as described in the Privacy Policy).

The Service itself — including its software, design, branding, and documentation — is owned by Dusk Analyst and is protected by intellectual property laws. Except for your content and third-party software, nothing in these Terms grants you any right to our IP.

Copyright and takedowns. If you believe that content hosted on the Service (for example, a shared report or a trade screenshot) infringes your copyright, please contact us at support@duskanalyst.com with a description of the work, the location of the allegedly infringing content, and your contact details. We will review the request and remove or disable access to the content where appropriate, and may terminate the accounts of repeat infringers in appropriate circumstances.

12. Data Deletion

You can delete individual trades, journal accounts (which also deletes their trades and screenshots), or your entire account and all associated data from the user menu in the dashboard. Account deletion is permanent and irreversible, and deletes all data linked to your account, including trades, accounts, notes, screenshots, tags, reports, notifications, feedback, affiliate information, and subscription records, as described in the Privacy Policy. You can also request deletion by emailing support@duskanalyst.com.

13. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY RESULTS OR INFORMATION OBTAINED THROUGH THE SERVICE (INCLUDING AI OUTPUT OR SYNCED TRADE RECORDS) WILL BE ACCURATE OR RELIABLE. THE SERVICE MAY BE SUBJECT TO INTERRUPTIONS FOR MAINTENANCE, SYSTEM FAILURES, OR CIRCUMSTANCES BEYOND OUR CONTROL. YOU USE THE SERVICE AT YOUR OWN RISK.

Nothing in these Terms limits or excludes any rights you may have under consumer protection laws that cannot be lawfully limited or excluded.

14. No Financial Advice

WE ARE NOT A FINANCIAL ADVISOR, BROKER, OR INVESTMENT ADVISER.

Dusk Analyst is a data-management and journaling tool. It records and summarises historical trading activity that you provide. Nothing in the Service — including Quant AI insights, Weekly Reports, statistics, charts, prompts, or any other content — constitutes financial, investment, or trading advice, a recommendation, an offer, a solicitation, a forecast, or a prediction about any market, instrument, or price.

Trading involves substantial risk of loss and is not suitable for every person. Past performance does not guarantee future results. You are solely responsible for your own trading decisions, and you should consult a licensed financial or tax professional before making any trading or investment decision. We make no guarantee of any outcome, and we accept no liability for decisions you make based on information obtained through the Service.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL Dusk Analyst BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) NZD 100. WHERE APPLICABLE LAW DOES NOT PERMIT A LIMITATION OF LIABILITY, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

16. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Dusk Analyst and its personnel from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of your use of the Service, your content, your breach of these Terms, or your violation of any law or the rights of any third party.

17. Suspension and Termination

We may suspend or terminate your access to the Service, in whole or in part, at any time if you breach these Terms, if we reasonably believe your use threatens the security or integrity of the Service or other users, or as required by law. You may stop using the Service at any time and delete your account as described in Section 12. On termination, your right to use the Service ends, and we will delete your data as described in the Privacy Policy.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and delete your account.

19. Governing Law

These Terms are governed by the laws of New Zealand, without regard to conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of New Zealand, except where mandatory consumer protection law in your country of residence provides otherwise. Nothing in these Terms limits any rights you may have as a consumer under the laws of your country of residence.

20. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Dusk Analyst regarding the Service.

Privacy Policy

1. Who We Are and What This Policy Covers

This Privacy Policy explains how Dusk Analyst ("we", "us", or "our") collects, uses, stores, and protects your personal information when you use the Service. We operate internationally, and this policy is designed to describe our practices in plain language while respecting the rights you hold under laws including the New Zealand Privacy Act 2020, the Australian Privacy Act 1988, the EU General Data Protection Regulation (GDPR) and UK GDPR, and the California Consumer Privacy Act (CCPA/CPRA). For the purposes of the GDPR, Dusk Analyst is the data controller of your personal information. Questions about this policy or your data should be sent to support@duskanalyst.com.

2. Information We Collect

Account information. When you sign in with our authentication provider (Auth0) — directly or using a social login such as Google — we receive and store your user identifier and email address. We also store that your email has been verified. We do not receive or store your password — authentication is handled by Auth0, which has its own privacy policy.

Journal data you provide. When you use the Service, we store the content you create or import:

  • Trades — symbol, direction, entry/exit prices, quantity, trade date, ticket, notes, and P&L. These may be entered manually, imported from a file you upload, or pushed automatically by your connector (EA/cBot) using your API key;
  • Journal accounts — the nicknames and starting balances you create;
  • Screenshots — images you attach to trades;
  • Tags — the tag library you create and the tags you apply to trades;
  • Reports — Weekly Reports you generate, including statistics and AI insight cards, which are saved to your account.

Files you import. When you choose a file to import, we keep a copy of it exactly as you selected it (which may include any other columns your platform exports, such as an account number). We use it only to check and improve how files from your platform are read and formatted, never for anything else, and we delete it automatically after 5 days, or sooner if you delete your account.

Import files you ask us to map. If a file cannot be read, you can tap “Send this file to Dusk Analyst” or “Upload file, we’ll map it for you”. We then keep that copy for up to 30 days so we can add support for its format or load your trades for you, and delete it sooner if you delete your account.

Feedback and applications. If you submit feedback through the Service, we store your message. If you apply to the affiliate program, we store your email and the application text.

Subscription information. When you subscribe to Pro, Stripe processes your payment and we store a subscription record (Stripe customer identifier, subscription identifier, status, and billing-period end date) so we can verify your access. We do not store your card number or bank details — those are handled by Stripe, which has its own privacy policy.

Technical information. Our hosting provider (Cloudflare) may process standard technical data such as IP addresses and request logs to operate and secure the Service. We also count page views ourselves, without cookies: each page load records the referring website and your country (from your IP address), and to count unique visitors we keep a one-way, salted hash of your IP address and browser type for that day only. The hash is deleted within two days and cannot be used to identify you. We also record the country you sign up from on your account.

3. What Stays on Your Device

The following data is stored in your own browser (localStorage) and is not sent to us except as noted:

  • Insights chat history — your conversation with Quant AI is kept in your browser. When you send a follow-up message in an existing conversation, the recent conversation history is transmitted to us (and to our AI provider) so the AI can continue the conversation, as described in Section 8;
  • the affiliate code you applied, if any; any CSV import parsers you save, which store only the column positions you mapped and never the file contents;
  • analytics and attribution data — a first-touch record of how you reached us (the referring site's domain only, never the full referring URL, plus any campaign parameters and the landing page you arrived on), a session identifier, a short queue of pending product-analytics events, and counters for your first visit and total number of sessions;
  • your cookie and analytics choice, so that we do not ask you again;
  • minor interface preferences (for example, which notifications you have seen, your theme, and when each connected account last synced).

4. How We Use Your Information

We use your information to:

  • operate, maintain, and secure the Service, including storing and displaying your journal data;
  • sync trades from your trading platforms via connectors;
  • generate the statistics, charts, insights, and reports you request;
  • process subscriptions and payments through Stripe, and administer the affiliate program;
  • send service notifications (for example, when trades are synced);
  • respond to your feedback and support requests; and
  • comply with legal obligations and enforce our Terms.

We do not sell your personal information, and we do not use your journal data for advertising. Under the GDPR, our legal bases include: performance of our contract with you (providing the Service), our legitimate interests (operating and improving the Service and securing it), consent (where we ask for it), and compliance with legal obligations.

Marketing emails. We only send special offers, product updates or trading tips by email if you opt in. We ask when you first sign in (accounts created before we started asking are asked once on a later visit), with a box that starts unticked, and you can continue without ticking it. You can change your answer any time under Email preferences in your profile menu. If you opt in, we record that you did, when, and the wording you agreed to, so that we can show you gave consent. We may give you a one-time bonus (such as free AI credits) for opting in; you keep it if you later unsubscribe. Links in our emails pass through duskanalyst.com first, so we can see which ones are clicked and improve what we send. Every marketing email includes a one-click unsubscribe link, and you can also ask us to stop at support@duskanalyst.com. We will keep a record that you unsubscribed so that we do not email you again. Declining, or unsubscribing later, never takes away anything you already have.

Weekly report email. Separately, after you add your first trades we may ask whether you want your weekly report by email (again with a box that starts unticked). If you tick it, we email you once a week, on Monday morning in your time zone and only for weeks with trades, with your trades, P&L and win rate for that week and a link to your weekly report. It contains no offers. We record when you asked for it and the wording you agreed to. Ticking it does not sign you up for marketing emails, and the unsubscribe link in it turns it off.

Daily check-in and its reminder email. The app keeps a daily check-in: each day you check in, or add a trade, import trades or complete a review, we record that date (in your time zone), how you checked in and the XP it earned, to show your streak, level and badges. After your first check-in we may ask whether you want a reminder by email (with a box that starts unticked). If you tick it, we email you on weekdays at the time you choose, only on days you have not checked in yet, and we stop after five reminders in a row that go unanswered until you next check in. It contains no offers. We record when you asked for it and the wording you agreed to. Ticking it does not sign you up for marketing emails; you can turn it off in Email preferences, and the unsubscribe link in it turns it off. Share images of your streak are made on your own device and contain no name or trading results; nothing is published unless you share it yourself.

Emails and in-app messages about your activity. If you opted in to marketing emails, some are timed to what you do in the app (for example, a short guide if you leave before adding a trade, or a reminder the day after your first trades). Inside the app we may also show messages based on your activity, such as a tip after you log several trades. These use your account and trade records, not cookies.

5. Data Storage and Security

Your data is stored on Cloudflare infrastructure:

  • Cloudflare D1 — a serverless SQL database on Cloudflare's global network — stores your account, trade, report, notification, feedback, affiliate, and subscription records;
  • Cloudflare R2 — object storage — stores trade screenshots and the import files described in Section 2;
  • the Service itself runs on Cloudflare Workers, and static assets are served from Cloudflare's edge network.

All data transmitted between your browser (or your trading terminal) and our servers is encrypted in transit using TLS. We apply access controls and follow industry-standard practices to protect stored data. That said, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security. You can reduce risk by keeping your API keys and login credentials confidential.

Retention. We retain your data for as long as your account is active and as needed to provide the Service. When you delete your account, we delete your data as described in Section 6. We may retain limited records where required by law (for example, tax-related records required by our payment processor) or as needed to resolve disputes and enforce our Terms.

6. Deleting Your Data

You can delete your entire account and all data linked to it at any time from the user menu in the dashboard. This permanently and irreversibly deletes:

  • all trade records, journal accounts, notes, tags, and screenshots (including images stored in object storage);
  • all reports and share links (shared report pages will stop working);
  • notifications, feedback, affiliate application and usage records; and
  • your subscription record (we also cancel any active subscription and ask our payment processor to delete the customer record, subject to the processor's own retention obligations).

You can also request deletion of your data by emailing support@duskanalyst.com. We will respond within the timeframe required by applicable law (generally 30 days or less). Deleting your account does not remove your account with your broker or trading platform — those are separate and must be managed with the platform provider.

7. Sharing with Third Parties

We share your information only with the providers needed to run the Service:

  • Cloudflare — hosting, database (D1), object storage (R2), and edge infrastructure;
  • Auth0 — authentication and identity, including social logins such as Google where you choose to use one;
  • Stripe — payment processing and subscription billing;
  • a third-party AI service provider — to generate Quant AI insights and reports (see Section 8); and
  • service providers we may engage for support, analytics, or operations in the future.

Each of these providers processes data under its own terms and privacy practices. We may also disclose your information where required by law, regulation, or valid legal process, or to protect the rights, property, or safety of our users or the public. If we are ever involved in a merger, acquisition, or sale of assets, user data may be transferred as part of that transaction.

8. AI Processing (Quant AI)

When you use Quant AI (the Insights chat or Weekly Reports), the relevant trade records from the account and date range you select — together with your question and, for follow-up chat messages, the recent conversation history stored in your browser — are transmitted to a third-party AI service provider solely to generate the analysis you requested. The request contains only the trade records and conversation content needed to produce the response, plus the connection metadata that accompanies any HTTPS request. We do not include your email address, name, account identifier, or credentials in these requests.

Insights chat responses are returned to your browser and are not saved to your account; Weekly Report content is saved to your account and appears in your past reports. Pro includes an allowance of 1,000 AI trade-analyses per calendar month; one credit is used for each trade included in a request, and the allowance resets on the first of each month. AI processing is performed only when you actively request it. We do not use your trade data to train or improve AI models on behalf of third parties.

9. Cookies, Analytics and Your Choices

We set no cookies of our own. Everything we keep on your device is browser storage (localStorage and sessionStorage), described in Section 3. We do not use advertising cookies, third-party analytics pixels, or cross-site tracking, and we never sell or share your data with advertisers. Our authentication provider may use browser storage and session mechanisms to manage your login, our payment provider may set cookies required for fraud prevention at checkout, and our hosting provider may set cookies required for security and operation.

We use three things to understand how the Service is used:

  • First-party product analytics — which screens you open, how long you spend on them, and which onboarding steps you complete. These records contain only fixed labels, counts, durations and true/false values chosen by us. They never contain your trade symbols, prices, profit or loss, account balances, account nicknames, tag names, notes, file names, or the contents of anything you import.
  • First-touch attribution — the domain of the site that referred you (for example example.com), never the full referring address, together with any campaign parameters in the link and the page you first landed on.
  • Cloudflare Web Analytics — privacy-focused traffic measurement that uses no cookies, no browser storage, and no persistent visitor identifier.

If you are in the European Economic Area or the United Kingdom, we ask for your consent before storing any of the analytics or attribution data above, and we store none of it unless you accept. Rejecting is exactly as easy as accepting. If you reject, we also delete any analytics and attribution data already held in your browser — including any affiliate code you had applied, which means an associated discount would no longer be attached to your account. Your login, your theme, your saved import parsers and your other preferences are never affected, because they are necessary for the Service to work at all.

In Switzerland, data-protection law requires transparency rather than prior consent, so this notice serves that purpose and no banner is shown.

You can change your choice at any time using the Cookie choices link in the site footer, from Cookie choices in your account menu inside the app, or by visiting this section directly. Our pages also load the Inter typeface from Google Fonts, which means Google receives your IP address and browser user-agent when a page loads. You can clear your browser's site data at any time; doing so may require you to log in again and will clear locally stored chat history.

10. International Transfers

We operate internationally and our service providers (Cloudflare, Auth0, Stripe, and our AI provider) may process data in countries other than your own, including the United States. Where the GDPR or UK GDPR applies, we rely on appropriate safeguards for international transfers, including the provider's data-transfer mechanisms and standard contractual clauses. By using the Service, you acknowledge these transfers.

11. Your Rights

Depending on where you live, you may have the right to:

  • Access — request a copy of the personal information we hold about you;
  • Correction — ask us to correct inaccurate or incomplete information;
  • Deletion — ask us to delete your personal information (you can also do this yourself — see Section 6);
  • Data portability — receive your data in a structured, machine-readable format;
  • Object or restrict — object to certain processing or ask us to restrict it;
  • Withdraw consent — where processing is based on consent, withdraw it at any time; and
  • Complain — lodge a complaint with your local data-protection authority (for example, the New Zealand Privacy Commissioner, the Office of the Australian Information Commissioner, a European supervisory authority, or the UK Information Commissioner's Office).

To exercise any of these rights, email support@duskanalyst.com. We will respond within the timeframe required by applicable law (generally 30 days). We may need to verify your identity before acting on a request. Nothing in this policy limits any rights you have under applicable law.

12. Children

The Service is not directed at children, and we do not knowingly collect personal information from anyone under 18 (including under 13, in compliance with COPPA). If you believe a child has provided us with personal information, contact support@duskanalyst.com and we will delete it.

13. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated policy.

14. Contact

If you have any questions, concerns, or requests regarding these Terms, this Privacy Policy, or your data, contact us:
